By applying to, accepting, or participating in any BrainGain partnership, affiliate, or influencer programme (“Programme”), you agree to the following Terms & Conditions.
1. Eligibility & Application
To be considered for a BrainGain partnership, you must:
- Apply through an official BrainGain application or outreach process
- Be approved by the BrainGain team before any partnership activity begins
- Maintain an active and authentic presence on relevant platforms (e.g. Instagram, YouTube, TikTok, Facebook or similar)
BrainGain reserves the right to accept or reject applications at its sole discretion and to reassess eligibility at any point during the partnership.
2. Partnership Structure
BrainGain partnerships may include, but are not limited to:
- Affiliate commission-based partnerships
- Product gifting or discounted product access
- Content-led influencer collaborations
- Hybrid arrangements combining the above
Each partnership is assessed individually. Specific deliverables, compensation, discounts, commissions, timelines, or benefits will be agreed separately and may vary from partner to partner.
Nothing in these Terms guarantees any specific form or level of compensation.
3. Commission & Discount Codes
Where applicable:
- Affiliates may be issued a unique tracking link and/or discount code
- Commission rates and discount values are set by BrainGain and may change over time
- Codes are for approved use only and must not be shared with voucher sites, deal forums, or third-party discount platforms
BrainGain reserves the right to suspend or deactivate any code if misuse, leakage, or abuse is identified.
4. Content Creation & Deliverables
Where content creation forms part of the partnership:
- Content expectations, formats, timelines, and platforms will be communicated directly by the BrainGain team
- All content must be original, truthful, and aligned with BrainGain’s brand values
- Content must not promote or feature competing adjustable dumbbell brands during the partnership period
Failure to deliver agreed content within reasonable timelines may result in termination of the partnership or removal of affiliate benefits.
5. Content Usage Rights
By participating in the Programme, you grant BrainGain a royalty-free, worldwide, perpetual licence to:
- Repost, reuse, edit, and distribute submitted or published content
- Use content across BrainGain’s social media, website, email marketing, paid advertising, and other marketing channels
This applies unless otherwise agreed in writing.
6. Gifting, Discounts & Product Access
From time to time, BrainGain may offer:
- Gifted products
- Discounted product access
- Early access to new releases
All gifting and discounts are discretionary, non-transferable, and subject to availability. BrainGain is under no obligation to continue providing gifts or discounts beyond what is explicitly agreed.
7. Compliance & Disclosure
Partners are responsible for ensuring that all content:
- Complies with applicable advertising laws and regulations
- Clearly discloses partnerships, sponsorships, or affiliate relationships (e.g. #ad, #affiliate, platform-specific disclosure tools)
- Adheres to the rules and policies of each platform used
BrainGain reserves the right to request edits or removal of non-compliant content.
8. Monitoring & Performance Review
BrainGain may monitor partnership performance, including:
- Content quality and brand alignment
- Engagement and reach
- Code usage and sales attribution
- Compliance with agreed terms
Partnerships may be reviewed, adjusted, or discontinued if performance or conduct does not meet expectations.
9. Termination
BrainGain may terminate a partnership immediately if:
- Agreed deliverables are not met
- Codes are misused or leaked
- Content is misleading, inappropriate, or damaging to the brand
- The partner breaches these Terms & Conditions
Upon termination, affiliate links, discount codes, and access to Programme benefits may be revoked without notice.
10. Changes to Terms
BrainGain reserves the right to update or modify these Terms & Conditions at any time. Continued participation in the Programme constitutes acceptance of any updated terms.
11. Disclaimer
Participation in the Programme is at your own risk. BrainGain is not responsible for:
- Platform outages or technical tracking issues
- Lost, delayed, or underperforming content
- Any indirect or consequential losses
All products and benefits are provided “as is” unless otherwise stated.
